By ordering our product, registering on our site, or if you have otherwise provided us with your personal data and information (such as your e-mail, phone number, etc.) shall be deemed to have accepted all terms of our business and thus accepted entering into Sale Agreement of our products and services in sense of Art. 32 and 22 of Law on Obligations of the Republic of Serbia, and that you have given us the explicit consent to inform you about our product range, promotions and offer of our products by phone, fax, e-mail and other means of electronic and distance communications, pursuant to Article 38 of the Consumer Protection Act (for more details, see Direct Marketing Rules).
Under these terms of business we deliver you our products, whether in our shops via telephone, via our website www.bigpizza.rs or via our mobile, tablet or other application.
Please read these business terms and conditions carefully before ordering our products as these terms will apply to all your orders. We also recommend that you print and retain a copy for future use.
By ordering our products, you agree to be bound by these Terms. If you do not accept these Terms of Business, you should not order our products. If you have any questions regarding these Terms and Conditions, please contact us via our contact form before you order our products. Your use of our site and any order of our products are regulated by the complete Terms and Conditions of our Business listed on this site. Please take the time to read them, because it contains important conditions that apply to you.
Ordering and acceptance of orders
These Terms and Conditions of sale shall apply to all orders for provision of products by us to a customer. The customer orders all orders in accordance with our offer for product purchase (you can see the complete offer of our products on our website www.bigpizza.rs by entering the address to which you want our products to be delivered, after which you need to click the "Delivery" option) in accordance with these conditions.
You may not place any order products on our website, if you are under 15 years of age.
To register on our portal, you must be at least 15 years old.
You are responsible for the accuracy and completeness of the data entered during registration.
Should there be any changes to the data entered during registration, please update your account as soon as possible.
Ordering of products by the customer will be made in absolute discretion on our part. Our acceptance of your order represents the moment when you receive on your screen (depending on device used to make the order) a message or confirmation that your order has been received and accepted by us, at which moment you have concluded a contract with us, and only until that moment we can decline to deliver the product without providing any reason.
Please make sure, when ordering, that the e-mail address, home address and phone number you are giving are correct. In the situation when you ordered our products to be collected yourself, please be sure that it is the point of sale where you ordered and where you want to collect the order.
Exceptionally, when ordering through our website products to collect yourself in our store, which is not able to deliver the ordered products, for example, if the store is closed, your order will be redirected to our second-alternative store. You need to check your order confirmation carefully before departure to collect your ordered products. In such a case, when your order is redirected to an alternative store, please contact us immediately if you want to cancel your order on our call center phone number 066/441-441.
Products delivery
Our goal is to deliver your order as soon as possible, or at the latest within 30 minutes of your order confirmation. If your order reaches you after 30 minutes, such order will be delivered to you free of charge. We will do our best to supply you with ordered products in accordance with the time we confirmed during the order. In the event that we exceed the guaranteed delivery time of 30 minutes and fail to deliver your ordered products within that period, as we have already stated, you will not be obliged to pay such delivery, but we will deliver you ordered products free of charge. We strive to maintain an excellent reputation for delivering our products on time. However, unfortunately, things do not always go as planned and factors such as bad weather conditions and traffic jam can occasionally prevent us from delivering in a timely manner.
However, the order will not be delivered to you free of charge if our delivery man has reached you within 30 minutes but you prevent him in any manner to deliver a timely order to you (for example, if our delivery man arrives at the address you indicated or comes literally at the door and calls you on the phone to check whether the address is correct or to simply open the door for delivery, and you do not open the door to him, do not respond to such a call or do not answer, and when in this way the guaranteed delivery time slightly exceeds or in other similar situations of your abuse of the concept of our delivery within 30 minutes). The relevant guaranteed delivery time of 30 minutes starts running from the moment you complete the entire ordering process and your order number appears on the screen of your device, or when our operator in the call center confirms the exact time of the order.
Exceptionally, within certain types of orders, your order may not be guaranteed for delivery within 30 minutes with the option of free delivery as mentioned above, and therefore such an order will not be free, and in such cases you will be clearly informed when ordering a product on the website or through a call center by our operators.
You agree to receive the delivery of the ordered product at a defined time and at defined place of delivery that you specified. When you order products, we will deliver the same to the defined delivery address or you can collect them at the store that you specified. If you are not present at the specified delivery address when ordering, we will not be obliged to refund you the order amount and we will charge you the full amount of the entire order.
We can as well make your order that includes a large quantity of products, but in that case we recommend that you contact us in advance and indicate the amount of the products.
In accordance with the minimum price of the order we deliver, we offer and provide the service of delivering our products in certain areas and regions where we operate, in order to ensure that our products are adequate when they reach you or your door. If you live outside the prescribed delivery area, we will not be able to deliver you our products, although in our stores you can always collect the products ordered personally.
We do not accept orders for cities or areas where we do not have a point of sale. Due to the safety of our drivers who deliver you with our products, drivers will (when delivering our products to business buildings, hotels, etc.) deliver such an order only to the main door, reception desk, etc.
In order for your order to be accepted for delivery, it must contain at least one product from the category of "Pizza", the category "Appetizers" (not counting sauces), chocolate pie or calzone with Nutella.
Canceling or modifying the order
You have the right to cancel your order by calling a call center, by phone on the wesite, as follows:
a. in case of a regular order (on the same day), you can cancel the order within a reasonable time before the products from your order have started to prepare. The operator will notify you if your request has been accepted
b. in case your orders were ordered in advance one or more days before the required delivery time (today for tomorrow), you can cancel your order no later than 4h before the required delivery time.
If you want to cancel the order after the preparation of products you ordered started, you will be charged a full price of the order without the right to refund, due to your mistake.
If you want to change your order, please call our call center at 066/441-441 within a reasonable time before the baking of products from your order started, but if you change the order after that time, you shall as well pay the original order.
In the case of a justified cancellation or change of order by you, if you paid the order with a credit or debit card, reservation of funds from your account will be released within 24 hours from the cancellation of your order on working days or on the first following working day, i.e. money will not be taken from you account.
Also, please note that any promotions of our products are only available for a specific period, and any changes to your order may mean that such promotions no longer apply.
We shall inform you about exceptional circumstances when we need to cancel the order we have confirmed. You agree that we reserve the right to cancel any order, before or after accepting it, and to notify you of such cancellation without delay.
You will not be obliged to pay the order that we have canceled. Any payment on such a basis will be canceled or we will reimburse you the amount paid in the same way as you made the payment.
Products
All products from our offer are subject to availability, that is, they are not always available or available for ordering. In such cases, we will offer an alternative to any product that is currently unavailable, or if the products you have ordered are not available, we can offer you a reasonable replacement for products of the same or similar quality and price or we can invite you by phone to indicate that the products ordered are not available and to ask if you would like to order something else. This can affect the price you are paying.
Our stores are very busy working environments with high frequency of work and there is a risk of cross-representation of some of the ingredients between the sauces, for example, If you have an allergy to some ingredients, when ordering online in the "Menu" section, please click the "Customize/Xtra Additions" option next to each product, where you can see information about allergens and, accordingly, you can remove some ingredients from the product. If you order products by phone, please notify us via the Call Center on the ingredients you are allergic to in order to secure that the product you ordered does not contain these ingredients. If you directly buy or order our products in our stores, please inform the store vendor about the ingredients you are allergic to, in order to secure that the product ordered does not contain these ingredients.
We have a certain number of products for vegetarian listed in our product offer. However, we do not have a dedicated place in our stores or in our production for the preparation of vegetarian food. If you are a vegetarian or a vegan, please inform our vendor who will do everything to ensure that any risk, from the cross-representation of ingredients that are not for vegetarians or vegans in your order, is minimized. If you order our products online via the website, when ordering, in the "Menu" section, click the "Customize/Xtra Additions" option, next to each product, where you can see information about vegetarian or vegan ingredients and accordingly create your order. If you order by phone, please inform us via the Call Center whether you are vegetarian or vegan in order to create your order accordingly.
We put great emphasis on the preparation of all of our products, however, we can not guarantee that all the bones from the meat products have been removed and some of them may remain in meat products.
Some of our products may be frozen beforehand.
Certain sauces and condiments, which are delivered to the customer and that are part of MIM Team Food doo offer, are spicy, very hot, sour or they generally contain all kinds of strong flavors, therefore we advise caution before consuming them. Customer agrees that MIM Team Food doo shall not be responsible that the customer or others may have, directly or indirectly, as a result of the consumption of these sauces and condiments or products containing these sauces and condiments.
Photos of our products on this site, in our offer, commercials, advertising material, etc., as well as at our sales points are set up for illustration purposes only. While we are doing our best to be consistent, sometimes the size or appearance of a product in ads or offer may vary slightly in size or appearance to the product you have ordered. In that sense, the actual products you have ordered and received may differ from the products shown in the photographs.

Transfer of Product Rights
The risk of the ordered products passes to the buyer at the time of delivery of the same, therefore please make sure during the takeover to check that you got the desired product. Customer confirms that all intellectual property rights on the products belong and will continue to belong to MIM Team Food and the customer as well undertakes not to violate any of the intellectual property rights of MIM Team Food.
Customer agrees that, in case of any dispute, written information about the products that MIM Team Food provides shall prevail over any oral statements given by employees of MIM Team Food. MIM Team Food shall make all reasonable efforts to ensure that such written product information is accurate.
Price and Payment
Unless otherwise specified in writing, the prices listed by MIM Team Food on teh website, are the prices inclusive of VAT and all other applicable taxes.
Product prices will be in such amount as stated on the website at the time you confirmed your order (by clicking on the order button) and such prices are considered valid. We shall not be held liable if in the event of an unintended technical error, data on the website change regarding the prices. In addition, we shall not be liable if you have an advertising or promotional material that contains prices that are different from the valid prices on the site or if you have found such different prices through such material.
The prices of our products that you order online or through the Call Center for delivery to you may differ from the prices that are shown in our stores for products you buy directly at the stores or which you order online or through the Call Center, but which you directly collect at the stores (without our delivery). Complete prices for our products can be found on our site by entering the "Menu" page. Also, when making specific orders of certain products via the site, you will be clearly shown the prices of the specific products you have ordered. If you order products by phone, our operator will notify you of the exact price of your order.
You can pay by any of the methods listed on the website. Make sure, if you are paying your order by credit or debit card that the same is currently valid on the day of ordering the desired product.
You agree that we reserve the right to terminate the agreement with you if your payment is declined or if we have reasonable doubt that your payment will be rejected at any stage.
You agree that we reserve the right to change the prices of our products, with the obligation to inform you about a new price when ordering.
Limitations On Liability
Customer agrees that MIM Team Food doo is excluded from any other liability arising from its supplying and delivering of products, and in particular can not be liable for any other damage or loss arising directly or indirectly from or in connection with a delay outside the estimated time or date of delivery, thence in case of the circumstances in which MIM Team Food doo he had no control over the resulting consequences and could not avoid by taking reasonable protection measures, or any indirect or unpredictable loss suffered by the customer or others. In this respect, the customer agrees not to have any other claim for damages against MIM Team Food doo, and we are free from liability other than the liability under these terms of business. In order to clarify this provision, in the event of delays in the delivery of orders, the buyer will be entitled only to receive such ordered products free of charge, which constitutes a compensation of damages and, through that, shall not be entitled to another one of such orders for free.
We deliver our products to individuals and corporate entities for private use only. You agree not to use any of our products for commercial, sales or similar purposes, and in that sense you agree that we will not be liable for any damage or loss, job loss, termination of business or loss of any business opportunity, etc.
If any provision governing the complete conditions of our business is found to be inapplicable or invalid by a court or other state authority, such a decision shall not invalidate any other provision that will remain in full legal force.
Written communication
Certain regulations stipulate that any information or data that we are sending to you need to be in writing. By using the site you acknowledge that such communication with us shall be mainly electronic. We will contact you by e-mail or we will provide you with information by placing a notice on the website.

Events beyond our control
You agree that, in circumstances caused by/in the event of Force Majeure, we will not be liable for any action we could not perform, for delivery we did not deliver, for incomplete or late delivery, as well as for any other obligation we have not fulfilled under these conditions.
The Force Majeure includes any action, event, act, omission, accident, accident, and the like, which we could not influence to, eliminate, etc., and which are beyond our reasonable control, including (but not limited to) the following:
a. strikes, lock-outs, and the like;
b. public rallies, civil disorders, riots, invasions, terrorist attacks or threats of terrorist attacks, war (whether declared or not) or threat of war preparations;
v. fires, explosions, storms, floods, extreme snow, ice, earthquake, epidemic or other natural disasters;
d. inability to use rail, ships, aircraft, motor transport or other means of public or private transport;
e. inability to use public or private telecommunication networks;
f. rules, regulations, laws, bans and similar acts of competent state authority; or
g. failure of the suppliers or subcontractor to perform their obligations.
Amendments to these Terms and Conditions of Business (Sale)
You agree that we have the right to change these terms from time to time. Any changes in these terms and conditions will be put and posted on our site. All the provisions of our business that are posted on the site at the time of your order shall apply to you, unless a change of provisions is required by law or by a decision of the competent state body.
Law and jurisdiction
Any agreement or legal transaction that arises on the basis of these business conditions shall be regulated and interpreted in accordance with the laws of the Republic of Serbia and MIM Team Food and the Customer are acknowledging the jurisdiction of the competent court in Belgrade.
